The short version

Check your policy. The time you have to report damage and the time you have to file suit are set mainly by your homeowners policy, and many policies require prompt notice. Do not wait: report storm damage as soon as you can. The Ohio Department of Insurance Severe Weather Toolkit advises calling your agent or claims line immediately because notice is likely required within a certain time frame.

What Ohio rules require of insurers

  • Acknowledge your claim within 15 days of notice.
  • Decide whether to accept or deny within 21 days of a properly executed proof of loss, or explain in writing why more time is needed and update you at least every 45 days.
  • Pay within 10 days after accepting a claim when the amount is settled.
  • Give you notice at least 60 days before a statute of limitations or contractual limit runs out, if you are not represented by a lawyer.
